Long Story Short. I work for a company as the office manager, basically I do it all... from payroll to checking in vendors. In light of recent events "I found out that one of the workers was clocking in under her husband's name" Asked the boss about this and he says he approved it. He states that she is collecting some kind of disability because she hurt her back an so he ok'd her to work under her husband's information.
Husband is also worker at facility. Same week I find this out... Another worker quits and I keep getting phone calls from former employee, stating that Boss does not want to pay him for the last week he worked. Talked to boss, and he says.... No pay!
OK... At this point, I can't sleep, I have anxiety attacks and well I decide I can't do this anymore, I know it is wrong on both accounts.
I go in on Tuesday morning, turn in my keys... and quit! Said, I can't do it. I feel things are not ran right and I won't be back.
Today I find out, he is also considering no paying me my final paycheck.
My question is, who do I report the 1st problem to... The working under someone else's name issue?
and
What can I do about him not paying me my last paycheck.

Your state Dept.of Labor for all the problems--these guys deserve a hefty fine, and maybe even a lawsuit. |

Most definitely...YES.
1) Worker on disability clocking in under husband's name. This is definitely illegal. This worker can't be on disability and be working at the same time. Doing so is considered fraud.
2) Boss not paying former worker and you the final paychecks. Also not legal. This boss is required by law to issue a paycheck for all hours worked up to the final "clock out" time.
Issue #1:
Before reporting you'll need to know if she's getting worker's comp or disability from Social Security or both. Receiving both is definitely illegal.

You have a very strong position against your boss. All you have to do is mention I.R.S. because what he is doing with having that lady work under her husbands name, is defrauding the tax people, and as you well know they just dont like to be defrauded. Just casually mention that you may have a talk with the tax people to see if what he is doing is correct and I am sure your last check will be in the mail. |
