I was scheduled to work 40 hrs for the week, at the first of the week my employer asked if I would work an additional 11 hrs at a diffrent job site, I did this to help the company and myself. The next day my site supervisor at my regular posting became very mad and terminated my possition on the grounds that I had not preformed my duities to her liking.I found out that my hours were being cut so that I would not get any overtime. My site supervisor was forced to work my hours so that I would not be over my 40 My supervisor at my regular job site has desided that I am no longer needed. Now I'm getting fired because I complained. My supervisor has made false allegations about my work to the company. All this is because I was being the reliable employee, and doing for the company "what I thought was" a favor. The verbal reason I was given for my release was that she ( my super ) was bringing back a single mother who needed the job more than I did. NOTE, She is also a single mom.

At will state or not, an employer stated that you were losing your job because a single mother needed it more. That, in my opinion, violates the law - because it is based partly on your gender. Thank heaven that this is what she said, and see a lawyer. |

Right to work state has to do with having to join a union - I'd guess you are talking about employment at will, not right to work. They can terminate you for pretty much any reason as long as it's not because of protected classes like your race, gender or religion. So if they are firing you, it's not legally wrongful dismissal and you don't have recourse other than to look for anyother job.

You have several different issues going on here (although right-to-work isn't one of them; that has to do with not having to join a union if you don't want to.)
#1) Your supv is mad because you were reassigned to another area for part of the work week and she had to work the hours that you missed.
#2) You were terminated for "poor performance" because your supervisor was mad even though your performance was apparently good enough for the company to ask you to work elsewhere to help out.
#3) Your supervisor told you that you were being termianted so that she could rehire a single mother (did she tell you this in addition to telling you that your performance wasn't good?)
Of the three, #3 is the most egregious since an employer can only hire on the basis of the job requirements and the applicant's qualifications to perform them. Whether or not an applicant (or employee) is single, married, a parent, disabled, Hispanic, young, old, etc. can't be factored in. You can file a discrimination complaint at www.eeoc.gov.
For #2, I'd try to appeal to the person who asked you to work in the other area. Let that person know that by assisting them, you have lost your job. You should also contact your HR department and inform them about the supervisor's decision.
