Wrongly Termination?

Hi I was offered a job last week for Google. Went ill from the 2nd day of joining. I was granted approved leaves. Before re-joining after 5 days with my medical certificates I was told that" We've hired someone else" Want to take legal advise as well. Please suggest.

Unfortunately your illness occurred during the 90-day probationary period and therefore subjects you to very strict attendance rules. You would be wasting your time and money seeking redress via legal means. Your best alternative -- seek another job and make sure that you health is in good order before accepting the new position.

I don't see how this could be wrongful termination. They are not required by law to hold your job for you, regardless of 'approved' leave. Medical certification does not mean the absence is 'excused'. If you had been there for a year, then you would have qualified for FMLA and could have sued for wrongful termination. But from your second day of work, you fell ill. Most employers have a 90-day grace period where they can terminate regardless of cause. If you are in an 'at-will' state, this makes your case doubly hard to prove. By all means seek legal counsel, but you may find your efforts best spent on seeking another job.
