can an employer change your annual date after being employed 5years?

Ok so here's my issue. I've been at my company for five years..my anniversary date is march 5th. When I first got hired I tore my acl, pcl, and mcl, and was out for surgery and recovery. My boss threatened to fire me if I didn't come back so I came back even tho I didn't fully recover from my surgery. Fastforward to 2008 when I was out for three months due to having my son. This year I was out dur to illness and had surgery to remove my gallbladder..that took a total of 3months again. So here's the issue now..I'm back to work and when I went to put in for a vacation day my boss told me he had to change my anniversary and I didn't have any vacation hours. It makes me upset cuz I've been here for five years..I have a total of three coworkers who have also taken time off due to medical reason or having a baby and none of them are having their dates changed. Only me. This seems really unfair and I've had plenty of times before where I felt harassed by my boss like he has something agaisnt me. I'm the longest working employee at this place and I feel like if anything I deserve better treatment for the years of bs iv put up with. Should I contact a lawyer? Also it has nowhere in our company handbook that states anything about my anniversary being changed or employement is put on hold when you take off due to unforeseen reasons or having a baby. I just feel like this is really wrong but I'm having trouble finding anything on the eeoc that backs up how I feel. Any ideas??

It is wrong. Contact the labor department or a lawyer for advice. You were collecting paychecks from the day you started. he cannot take time away from you when you have been employed by him from day 1. Sounds to me like he is trying to save a few bucks by cheating you out of your vacation pay.

Contacting a lawyer won't do anything for you. Your boss can not only change your anniversary date, he could stop giving you any vacation at all. It sounds like he changed the date due to all the time you've been off.

I'm guessing the issue is that at 5years you were expecting an increase in vacation time. It sounds like you have only WORKED 4yr 3mon (or about that). Of course, you need to work then entire time to earn additional benefits or any vesting.

Sure, he should be treating all his employees the same. But really it's none of your business the pay or benefits your coworkers receive.

I have been with my comapany for a total of 12 years, I was out sick for 3 months because I was ill from my Lupus, when I returned, they told me my Anniversary date had changed o 3 months out, by the way, I am African American, A wihite coworker went out on Maternity leave in March and has not returned yet, and I just got her information today for her annual raise..can they change the rules as they go or is there some type of law forbidding this..
