Here the thing. My husbands ex-wife has been keeping his kids away fro him. He hasnt seen them in a while. His son is now 18 and his daughter is 14. He has filed paper to take her back to court to try to get his weekends back with his daughter. His ex-wife is mad and sent him a dentist bill of the sons that is 3 yrs old. She never told him about it and now she is saying that by law he has to pay. Does he?

Yes, I believe he does have to pay. I just asked a lawyer about something similar to this a few days ago. I was told the statute of limitations in most states for past due bills is 6 years. 3 years is well within that, so he might legally have to pay. However it's obvious that the mother is attempting to use this bill as a form of manipulation, and clearly she's angry that he wants visitation. I would send her a certified letter with request of a signed receipt, saying that he has no problem paying if it's found that he does, in fact owe her, but he will not pay her until the court deems the bill legitimate. The two of them can bring it up in court, and they can hash it out there. Hopefully he'll be able to plead his case, and it'll be clear that she's attempting to manipulate him through a bill. However, honestly, I believe he will be ordered to pay the bill. It's the same as back child support; fathers don't get released from paying child support just because it's 3 (or more) years old. And with the statute of limitations on bills, I think he'll be ordered to pay. But the courts can easily hash this one out and give you the definitive answer. |
