Arya Samaj wedding registration?

I will be getting married under the Special Marriage Act, 1954. Post that, I would be getting married under the Arya Samaj Act. Would the registration of the Arya Samaj marriage be null and void since my marriage would already be registered under the Special Marriage Act?

The marriage under the Special Marriage Act,1954 is civil form of marriage where as the Arya Samaj Marriage is religious form of marriage covered under the Hindu Marriage Act,1955.
The Civil Marriage under the Special Marriage Act,1954 is Registered marriage, where as the Arya Samaj Hindu Marriage is not but has to be registered under section 8 of the Hindu Marriage Act,1955. The non registration of the Hindu Marriage doesn't invalidate it however the Civil Marriage under the Special Marriage Act,1954 is valid only when it is duly registered & valid Marriage certificate issued by the Marriage Officer/Registrar.
In your case you will be already legally married under the Special Marriage Act,1954 & any further religious marriage after the civil marriage will be of no consequence from legal point of view, now as far getting the Arya Samaj marriage further registered under the Hindu Marriage Act,1955 is concerned,that will not be allowed by the Registrar of Marriages as your civil marriage has been already registered. You need not bother about the registration of your Hindu Marriage as that will be just for public satisfaction not legal satisfaction. |

Yes...according to my expertise in both Special Marriage Act 1954 and the Arya Samaj Act...Yes, the Arya Samaj marriage would be null and void. |

Arya samaj wedding is a part of Special marriage act(court marriage) and is done after all the court formalities have been done.It is not that important since you would be carrying your court marriage certificate but yes it is an essential part done by the lawyers itself to get the proofs of the marriage( wedding pictures , guarantors pics) and satisfy all the formalities.
It is a real fun.I attended one of my friend's marriage.Best of luck and congrats. |
