Is there any legal way that I can get my husband to leave our house instead of me and my son moving out. I run my own daycare out of my house but he says that he gets to stay because he pays all the bills.

if your name is on the deed too, u would not have to move out. u can't really make someone leave their home unless they are violent and u got a restraining order on them. |

i agree with the other reader,the name on the deed is who owns it. if both of you are on it,i would ask a lawyer,and tell them that you have a business out of the house,i would think it is you,however i would ask. |

I would consult a lawyer, but in most cases where you are married, the assets are shared. The only way you can get him to move out is with a restraining order. |

I don't think you can unless you evict him. But since it's his residence it's his too...you'd have to ask him nicely to move out and maybe help him set up his own place to live. |

If you and your husband are getting a divorce, then you may be able to have your attorney file a restraining order. But, if you just want him to leave, he doesn't have to do that. Of course, if he does leave, then you'll have to pay all of the bills! |

Get a lawyer. If he thinks he's paying all the bills he will be surprised at what an award you will get for upkeep then. When you file you can get him removed. Do it now. |
