If a 16 year old girl who has no parents and is living on her own wants to get married to an 18 year old, can she legally be married in the state of new york without parental consent?
Also, if her future husband has a child, can she adopt this child?

if you didn't go thorugh legal proceeding to ensure that you are emancipated, or at least in some way legally proven that you are an independent, you are still considered a minor and would need parental or guardian consent if you're under 18.
the same goes for adoption. a "child" cannot adopt another child.
I absolutely 100% agree that you're smart enough to make the right decision, and by all means yo are an adult, but the state doesn't see it that way.
if you go to your county's courthouse to apply for a marriage license they will have all the forms that you need, which will also entail all of the stipulations to obtaining one. |

If you haven't been emancipated, you can't get married without consent from both parents. And no, you can't adopt a child. A child cannot adopt a child. |

Here are the rules... You are going to need parental consent.
Under 18: If either applicant is under 14 years of age, a marriage license cannot be issued. If either applicant is 14 or 15 years of age, such applicant(s) must present the written consent of both parents and a justice of the Supreme Court or a judge of the Family Court having jurisdiction over the town or city in which the application is made.
If either applicant is 16 or 17 years of age, such applicant(s) must present the written consent of both parents. If both applicants are 18 years of age or older, no consents
are required.
One parent alone may consent to a minor's marriage if: The other parent has been missing for one year preceding the application; The parents are divorced and the consenting parent was given sole custody of the child when the divorce decree was awarded; The other parent has been judged incompetent; or the other parent is deceased. Parents, guardians or other people consenting to the marriage of a minor must personally appear and acknowledge or execute their consent before the town or city clerk or some other authorized official. If the notarized affidavit is made before an official outside of the State of New York, it must be accompanied by a certificate of authentication when the consent is filed in New York State.
Familial Restrictions: A marriage may not take place in New York State between an ancestor and descendant, a brother and sister (full or half blood), an uncle and niece or an aunt and nephew, regardless of whether or not these persons are legitimate or illegitimate offspring.

First of all, it's illegal for a 16 year old to be living on her own no matter what the reason. I'm surprised the state hasn't put you in foster care. Second, marraige at 16 IS legal in most states with parent or guardian permission, in this case the guardian SHOULD be the state. Now, if you tried to get a marraige license at 16, this will all unravel at the county clerk's office.
Slow down, keep your pants on and your hormones in check. You're way too young to be jumpinginto something like this. |

With parental/guardian consent YES, but I do not recommend it. Over 85% of young marriages end in divorce. A teenager will have more then one love before she/he finds that life long one. Marriage is often miss-perceived by young couples who believe the other will always grow with them, expectations of two young people are usually not set to what really happens. It is best to have the career, finances and education completed so you don't struggle. Take it from me, not only have i been there, but I also counsel couples every day. Statistics prove that couples who wait have a higher marriage success rate and couples who wait til they are in their 30's have the best success rates. Your life will change so much on it's own. Men mature at a slower rate then women. Wait til you are 23. I guarantee you will see him in a different way maybe good, maybe bad. He will have had a chance to prove he can make something of his life and it will insure you are both heading on the same path. It's just so important and 23 for you (NOT him) is a monumentally important age of clarity and revelations. It's so hard to get divorced now. I mean they get a year, then 30 days to answer the divorce complaint, then another 30 days to answer the default, then they get to contest at your hearing and delay it, then even if they don't show up they get another 10 days. My lawyer has seen it held out as much as 3 years.. Do you really want to go for it now and then what if? I mean it takes too much to get divorced that you can still be fighting even if you meet and get engaged to someone else, not to mention it costs serious bucks to get divorced? So wait, live with him first when you are 18 and see how it goes. I'd prefer marriage before living together, but I know how I was, love was everything when I was your age, but promise me you will at least wait and if you decide when you are 18 to live with him?
And as for the kids. I am now in my 30's and met the love of my life who has kids. Taking on other people's kids is not easy, especially dealing with the ex's. I tried to help them both (my now fiance and his ex) but she is just nasty. I am told that is common in step parent/parent cases.

I do not know of any state that will allow a minor to marry a lawful adult . That would or could cause a felony charge to be filed upon the 18 year old . Or some lesser charge |

Yes but you have to have legal orders from the court that you are considered an adult living on your own or have your legal guardian sign for you . Other then that your still considered a baby even if you have your own place . |

It depends. You say that you live on your own. Are you emancipated? Do you have a legal guardian? If you are emancipated then I'm not sure how it would work, although i'm sure you could. But if you have a legal guardian you would have to get them to sign for you. And I know you don't want to hear this, but make sure you think about it before you do it. I mean, you're 16. you have your whole life ahead of you. I'm not saying it won't work, but if it is true love, what is the rush? What is another 2 years if you are in love and plan to stay together forever? |
