me and my ex have a 2 yr old together and when we split I gave him legal joint custody and moved back to rhode island. He lives in ct.. For
a whole year he had inconsistent visits and constintly harrases me, he also never gave me a dallor for medical exps, or came to any doctor visits.. I filed for legal sole custody and he then agreed and I now have temporary sole and he has visitations.. Now he decides to file an emergency order and decides to ask for sole custody and makes false statements about me.. we went to court and didn't even see the judge.. Now he changed the order from emergency to and non emergency and now he asks for legal joint and the he wants to fight forsole custody.. What are his chances?

If you have documentation of his lack of visitation and support his chances are slim.
You can show he did not take care of his responsibilities and would not be a good father.
If you go to court take your proof and witnesses. |

Be sure and keep a log of everything he's not done as he's supposed to, including not showing up for visits, not calling if he's not coming, and not paying for bills. That makes a big difference in custody battles. Also, a woman usually has to be proven unfit for the man to get custody, especially of a young child, so unless there is some fear of that I almost wouldn't worry about it at all. |
