I have been the primary care taker of my 2 yr old child, I have temorary sole custody, I tryed to get along with him for my child but he just won't give up.... Now he is seeking full custody, he lives in another state. He is claiming that I am not mentally right and I am a dancer. I work at a clean club and theirs no contact! He always new I was a dancer and now he's using it for a reason.. He has a long record with drugs, domestic abuse and more.. My record is clean, im in school and have a stable home.. Nothing was never a problem untill I got in a realationship and soon to be married! Additional Details Yes I been working at the same club for 2 yrs, i dont drink or use drugs. I do have a lawyer im just worried because his lawyer is very agressive!

since he is the one with the record i wouldn't worry too much about it. they aren't going to take a child out of her home unless there is some threat to the child's safety. being a dancer would not matter to the courts. u need to bring things up about his character and record when u go to the hearing, u need to tell the courts u fear for your child's safety, would be a good idea if u could prove the things on him like get his records for the courts. |

Don't worry about it sweetie. The court looks at what is best for the child. If you have been the primary care then chances are you will remain that way as long as you are not unfit and being a dancer isn't unfit I don't believe. he won't win. |

i wouldn't worry about it to much,you have a lawyer and your lawyer is on your side,he might have one that is very aggressive but,due to his past id say you have the better chance of getting full custody of your child,i went through the same thing with my husband,and as long as you have no criminal back ground and have a secure place for your child you will prevail it takes alot for a judge to take away parenting rights from the mother,and since he also lives out of state that's also a plus for you,besides he and his lawyer has to prove that you are mentally unstable,and unless you have had some mental issues that you sought medical attention for such as suicide i say he doesn't have a chance in hell getting your child,and as long as your providing for your child and the child in a stable enviorment,you have nothing to worry about,you being a dancer doesn't make you a bad person,i have a friend in Phoenix that is also a dancer raising her son,but that doesn't give good reason for any judge to remove your child from you,set back and let your lawyer handle the details,i assure you the outcome will be in your favor,as it was for my friend besides that's what your paying him for,so relax,stay in school do as your doing?and you ll find that everything is going to be ok, i am sure your lawyer has pro bally told you that its not easy for a child to be taken from the mother,you can also ask your lawyer what he thinks your chances are and hell probally tell you what iam telling you know,you got my full support.stay strong the strong always survive. |

Not likely. From what you describe, the judge wouldn't give him full custody. Not if you can prove the drugs and domestic abuse. If your record is clean, you have a stable home, income, and you've been the primary caretaker for the first 2 years. The judge should either grant you full custody, or if you're unlucky, he may get visitation rights. Hopefully, he doesn't though, and you get full custody, and he gets no contact.

if your job is bringing in a steady income, you have support from family adn friends and his drug history is true, then i would think it wold be very unlikely that he would be getting custody.
I do, however, think that with the situation you are in, you need to be seeking the help of a professional and getting better advice than yahoo answers.... |

courts normally side with the mom, unless its proven that she is incompetent, or incapable of taking care of the child. if you have a clean record, are in school and have a stable job, then it should be ok. just because youre a dancer doesnt mean you're not a good mother. it does bring up some questions though that you and your lawyer need to be ready for. if your lawyer isn't able to handle the other lawyer's aggressive nature, then get a different lawyer who is. |

he can try. he wont get very far. if you have a stable job, stable home, and a clean record, your pretty good. also since youve been the primary caretaker and havent had any complaints, on your record. the judge will favor into you. you have nothing to worry about. you will win the case. the only reason his lawyer is agressive is probably because he doent want to lose but he knows hes going to lose. so hes trying to scare you. all i can say is you sound like a good mother. i know you will win the case. you have nothing to worry about. also you can find better and deserve better then him, as in the childs father. |

It is very difficult to take custody away from a mother....as long as you are not abusive towards your child and provide a safe home, I do not see how he can get custody...Do you have proof of his abuse and drug use? If he has a long criminal history, it will be difficult if not impossible...I am not an expert, but look up the laws of your state...I have a male friend of mine who was told by his lawyer it is extremely difficult to take custody away from a mother...but that is our state. Especially with abusers, they are angry you left and are trying to hold on anyway they can..get a lawyer!.. |

I doubt he'd get it, but he can try. I don't think they'd remove the child from the parent s/he's has been living with unless there's evidence of something bad, which I doubt he'd be able to provide, and with his own record it wouldn't look too good for him. Good luck, do you have a lawyer?
