I'm in the divorce process right now and it's almost done and over with. I have another year of school and then I'm going to try and move closer to a guy I'm sort of dating. I'll still be in the state of Ky but 3 hours away from my ex. I was wondering whether legally I'm allowed to move and whether he can stop me from moving by taking me to court and such. He does have visitation rights which I'd have to get changed due to the long distance between me and him

yes he can stop you. all he would have to do is file for motion in court and you are dead in the water. |

It appears that you have children. Check with your divorce lawyer because it's not uncommon for people not to be permitted to move out of the state/province when children are involved.

Yes, if there are minor children involved, he can rain on your parade, and keep you from taking the kids out of state. I am going through the same thing right now myself. I married a beautiful woman that I met on the internet, and I am moving me and my two sons from Michigan to Illinois. The thing is, my ex-wife gave me consent. If you are not crossing the state line and can still have the agreed upon custody agreement without interference, he should not have any say in where you move. Thats a question for your attorney. He'll know the laws defined by that state in this case. |

If you're getting majority custody, typically all you would have to do is notify him in writing 90 days prior to your move your intent on moving.
He could file a motion to modify visitation but really can't stop you.
However, if you continuously move around pursuing men and drag your children along, that won't look too good in court. |
