I left my husband 6 days ago he and his family made my life hell till I did. Today I find the reason why,he has been seeing this lady behind my back .
He will go into a rehab soon for his 3rd dui,and told me that he will let her live in our home till hes back out. The home is in both our names we have not filed for divorce. If he did he never said any thing to me about it.
I know in ohio is a 1 year waiting peroid, he is still my husband . can I go have this lady kicked out of my home when he is away or can I take what is mine from the home?
I just had bought a big screen tv in my own name and had to leave it also do I have rites to it can I take it from the home.
He knows I cannot afford a lawyer yet so he is taking advantage of me . seems he is the one playing and having all the fun and Im the one homeless and nothing.

i believe u can have her removed from your home. i would not leave my home because when u do its sort of like abandoning it. u go back to your home, kick her out and change the locks while your at it. u should get half the home when u divorce. |

You're both equally responsible for the house. Since he's not there, and won't be there for however long, you assume all the responsibilities. This includes not allowing trespassers. If you call the police they will have every legal right to remove her. She has no stake in any of this. It's your home, and you can decide who stays there.

YOur name is on the home papers not hers. All it takes is one call to the police.
If he is not there in person, you can call the police and have her forcible removed. No problem. |

Technically, since its yours and ur husbands name on the deeds, when hes not there, its your house. And if she does not leave if you ask her to, she is trespassing. Call the cops |

I had a similiar situation myself, what you need to do is call up to the your counites police department, and ask for a escort to go into your home and get your belongings, and/or ask them what you can do to have this woman taken off the property, im pretty sure she can escorted off the property because it is technically not her residence, its yours and yours husbands, and your husbands currently in rehab, and if she recieves her mail at your home then shes elligable to stay at your residence but because she is living in your home, you have to give her a months notice ( this is an actual law ) that she is being kicked out. And if she does not recieve mail at your residence then she is just a guest and can be escorted off the property by police, and if you have any problems with her coming at you or coming to the house then file for a restraining order. |

you have the rights to everything that you paid for, and the things that are in your name, so you can take the TV.
I think that you could order her out of the house when he is not there as it is your house to, I would ask her to leave and then phone the police if she does not, otherwise you may make it worse for yourself.
But, if your leaving, take your stuff with you. You dont want him to get his hands on them. |
