If I marry a rich person, and sign a Pre-Nup beforehand, and then they want to divorce me leaving me with nothing, can I just refuse to sign the papers.
And whilst I'm married, does that mean that the money is technically half mine, and I can spend as much of it as I want?

The prenup is valid, and if you refuse to sign the papers, they have a waiting period, but are still granted the divorce. And, the prenup should state what is yours from the assets gained during the marriage. Did the person who signed all this read it before hand? |

It takes 2 to get married, and only 1 for a divorce. If you sign a prenump and it is legally documented and notarized, it's basically wrote in stone. And no, while you're married nothing is yours, unless your name is on it. Your name must be in checking accounts, savings, cds, ira, to be yours or half yours. House must have your name on the deed, cars, etc. |

you need an attorney, because a prenup can be contested, if you can demonstrate it was entrapment, or that you were forced to sign, and that he left you with nothing, essentially to use you, and not reward your due. no, the money is only 50/50 if there was no prenup and you live in a community property state. it depends on the length of marriage and children born as well. like i said, get legal advice. i am no attorney, but if you can prove you were manipulated by a rich guy to take advantage of your socioeconomic disadvantage, and he messed it up, or cheated, then gets off without a scratch, you win |

Ok...do you know what a pre-nup is? the term "pre" means BEFORE marriage... so its up to you to sign those papers before the divorce, not during.
Secondly, forcing someone to divorce you is not the correct term for your question either. Basically you should be asking... can you force someone to STAY married to you? No... nobody is obligated to stay married if they don't want to, if you don't sign the divorce papers that means that the divorce decree is uncontested and the person requesting the divorce gets everything they asked for. |
