Can you still get a divorce a year latter techically if you still let hubby stay because he had nowhere to go?

a friend left her hubby back in april2008 she had to let him stay again with her because he had nowhere to go.Can she still file for divorce in april2009.Will they have to wait another year.

I don't know about your state but in VA you have to live separate and apart with no intention of living together for a year if you have children or six months without children. Either way I don't think that they can live in the same house and still get a divorce.

She can still get the divorce as long as they aren't sleeping together or anything. If he has his own room or takes the couch then yes she can still get the divorce. They aren't together she is just helping him out so they are still separated and can get the divorce.

You don't always have to be separated for a year to get a divorce. It depends on the state that you live in. I am divorced and live in Georgia and did not have to separate for a year.

Yes they can still get divorced. With today's economy there is a lot of this happening. I seen a story about co-habitating exes on the news not long ago. yes they can get divorced.

P.S. Some states may require seperate living quarters, but many do not.
