Dad took kid! Custody issue!?

Unfortunately, although our court date is scheduled, we have not made it in front of the judge yet. So, there is no court order regarding custody. Initially I was not going to let him see his son until court, but then we agreed that he would be see him two specified evenings a week until court.

My son's father picked up my son without my permission from daycare on one of his non-agreement days. As any mother would, I called the police, ncmec, and whoever else would listen. I called him all evening, all night and all day today. He then texted me earlier stating that he will be bringing my son back later this evening. He has yet to arrive.

My question is...

What the hell should I do? I am livid that he would do this to me! My emotions are overwhelmed and I don't know if I should place a restraining order on him to "prevent" this from occurring again. OR what I should even do. I would love to hear your opinion on this matter and how I should treat/react to this situation to ensure it does not happen ever again.
Additional Details
I want to know how I should interact with his father now. I am frightened he may do this again. Do I request supervised visitation? Do I forgive him and act like this was just a huge mistake?

Can you change day care's once he brings your son back? Don't tell him where you have him at and he won't be able to just take him. Good Luck.

There is nothing you can do. he hasn't broken any laws, He is entitled to have your child just like you do.

With out a custody order he doesn't need your permission. the police cant and wont do anything.

Just calm down. take a deep breath before you do something that you will regret later.

you have no grounds for a restraining order. You are correct, you are over whelmed with emotion
. You sound like a spite-full women, you state you were not going to let him see the child in till an order was in place. its no wonder why he took the child!

Go to court and get the custody order!

If he sees that you are so upset that you cant make a rational decision he will know how to get to you during the custody phase.
I would ignore him. just get your child back any way you can, lie to him or whatever, just be nice to him,and don't let him see the child in till there is an order in place. You would not be breaking any laws by doing that.

You don't have a court order for visitation, so your child's father has just as much right to him as you do, and he doesn't need your permission to take him from daycare.

Perhaps you need to step back and remember that, while YOU may be divorcing this man, your child is NOT. If you honestly believed that your husband would be a danger to your child, then you should have petitioned the court for temporary visitation orders until court.

You save the text, and document everything. Make sure your lawyer is aware. And have a witness there when he returns the child. Be polite and controlled. He has done nothing wrong legally, and if you go postal on him, he will use it against you. That's why you need a witness. He did this just to provoke you. Don't let him succeed. And don't ever say or do anything upsetting in front of the child.

Possession is 9/10Th's of the law. You have no recourse until there is something ordered by the court.

He could not even bring him back to you if he doesn't want to. My suggestion is to act cool until after something is in writing.

Sense he's also the parent, and no papers have been filed, he has every right to take his son and return him when he feels like it.

I suggest going down Monday morning and file for temp. custody. There will be stipulations filed in the papers.

This happened to me. My ex kidnapped my 2 son's. It ook me 6 weeks to finally know where they were. My one son got in trouble at school......( ex took them from MI all the way to WY) and to hopefully get away with not getting in trouble by his dad, he told them he'd been kidnapped. I hauled asssss to get them. The school in WY told me to not do anything at te school.. I showed up there anyways!! With a temp order in my hand! They called the cops and belve it or not, they made a phone call, and the next thing know, we were getting a police escort out of town!!
