me and my wife are going threw a nasty divorce....she sent me some papers and there is a phrase that worries me...it says that she will have sole physical and legal custody....does that mean i will be signing my rights away....im letting her have full custody but i do not wont to sign my rights away

Sole physical custody means the child(ren) will live with her.
Sole legal custody means she has exclusive right over any and all decisions regarding the kids. This includes deciding if and when you can see them, where they live, go to school, medical treatment, etc.
DO NOT SIGN anything. Sole physical and legal custody means if she doesn't want you to have anything to do with the kids, you don't have anything to do with the kids. No visitation, no input, nothing.
At the very least, fight for joint legal custody and generous visitation. |

If you give her sole legal custody, then yes, you are basically signing away your rights. You won't have any say in any decisions that affect your kids. You will have visitation and thats it. I would try for at least joint legal custody - which the only way you wouldn't get that is if you are just that irresponsible. |

You are not signing your rights away but that means that you really have no rights to them at all. You should be asking for joint legal at least |

it means that u wont have a say in anything to do with ur kids... where they go to school, the doctor, live etc... give her joint custody with residency. |

Most divorce papers have the standard wording and what you quoted is pretty much standard language. You are giving your wife legal custody (under no protest from you) and your children will physically live with their mother. You still have the right to see your children to arrange visitation with them & to speak to them. These arrangements must be made before the divorce is finalized. Hope this helps. |
