I have been paying support (joint custody) for the last 5 years but recently I have taken over sole custody of my son. I will be taking over Shared custody of my daughter in a couple months (shared custody in Alberta is over 40%). Does anyone know if I will have to continue to pay support. She tends to think that I would still have to pay full support for my daughter and that she would have no financial obligation to pay support for my son because I make twice as much as her.

I find it amazing how little people understand child support. Both parents pay, it has nothing to do with how much you make. The income of both parents is entered into the formula, and then what portion they pay is determined for both. It's just that one parent writes a check for the custodial parent, while the custodial parent pays providers-doctors, grocers, tuition,...-directly. Even is you make more than she does, she will still have to pay something, although it may be a very little amount. You will need to file with the courts for the child support order to be changed once you have custody. |

She should have to pay you at least some support. Most states have a minimum child support amount no matter what the situation is (even unemployment). Good luck... I'd file for a modification and let the court take it from there. |

I think that you should be getting support because you have one child full-time and the other one half the time, so your ex ends up with one child half the time only. It should be reversed. My husband's son was going to live with us, and it was the same, she still wanted us to pay her. You gotta go to court to get it all reassessed. |
