Ok, My boyfriend and I were together for 5 years. 4 in Colorado, 1 in california. He is an avid alcoholic and abuser. Talking 9 Duis, and running from probation from Colorado to california. He kicked his daughter and I out January of this year. In which I had no where else to go but back to my home town of Denver with family. I have resided here since 2000. I have filed for Emergency Jurisdiction dur to the abuse that was present and threats against our daughter. Now he has filed a Motion to dismiss. How does this work???? But in motion to dismiss he states he has never lived in Colorado, and has never had a relationship with me in Colorado.. Excuse me we lived together for 4 years here.... I can prove the property damage he denies. I can also prove the fact that he has had a total of 3 apartments here as well as a Dui in 2004 which he disapeared in 2007 to California. WHAT DO I DO????? How can I fight this??

Wait if he was on probation in colorado that proves at least partial residency. Just hand in there. |

Get whatever factual documents you have together and witness statements with regard to CO. Go down to the courthouse and see a clerk.
BE sure the courts did not serve the wrong person (someone with the same name), which could explain the person's Motion to Dismiss. |

Sounds like he is trying to avoid Colorado at ALL costs. Stick with it. You resided in Colorado, that is where the case should be heard. Good for you, bad for him. |
