Getting divorced in Florida?

Hi,

I have a question regarding Florida Divorce: my wife and I have been married for a bit over a year now. She had gotten violent a few times and was arrested last year (I pleaded for her not to be arrested, her family called the cops... I ended up dropping the charges later on). We went to counseling and she even started seeing a psychiatrist, but stopped going consistently and did not take any of his advice. Every day I when came home from work she would tell me she wanted a divorce and how she loved her ex. Certain events happened late last year and she was getting involved with another guy... she ended up moving out in the beginning of this year. I've been trying to talk with her about doing a Simplified Dissolution of Marriage, however she will not sign the papers. I honestly do not want this to be a lawyer-lawyer battle (don't have the money for it and when there is so little in assets, I don't think there is a point to it). She, however, has stated repeatedly in text messages how she is going to get everything in the divorce.

What can I do? I want to move on with my life and get this divorce over with. I'm sorry if any of this is confusing. I have tried to be extremely flexible in dividing assets and I believe I am being more than fair - but it seems she is just changing her mind to drag this process out and is now talking about wanting to get back together with me, which I do not want.

As far as assets and possession go, they are as follows:

1st car, paid off - she is currently in possession of it and I have offered to have the title transfered solely into her name (right now it is in "OR").

2nd car, financed - I am currently driving it, I purchased it brand new for her last summer and I have made every payment by myself on it.

Apartment, leased - solely in my name. Most of the furniture in it we purchased together (using mainly money I brought in), however all of the furniture she had prior to us being married I would like for her to keep.

I pay for all of the bills and utilities and since the separation we have split phone accounts and car insurance so we do not have any joint bills. I had paid for her car insurance up until this month.

Credit cards - we have closed all joint accounts and I have paid of the majority of them on my own. (even a card which is solely in her name).

When we got married she resigned from work to study full time and I was the only provider, the only thing that she did relating to money was run up the credit cards. I had over $16,000 in savings and cash about the time of the marriage and by the time we split up, I was in debt (credit cards). She went back to work in November and makes enough to take care of herself (even enough to unwisely spend it). If it makes any difference we are both in our early 20s.

u go get the paperwork either from the county where u live or a paralegal, u fill out your part, take it back to the courts have her served, she will have a short time in which to respond, and send her paperwork back, if she doesn't respond, a court date gets set anyway, and u get your divorce by default.

If she moved out, then she basically abandoned the property. I got divorced in Florida a very long time ago, so I know the laws might have changed, but she abandonded her stuff, therefore I think she has no right to it. You can contact a lawyer and usually the first consult is free. See what they can tell you and what would be your cheapest route to take.

Good luck to you. Sorry about your luck in finding the wrong woman. There is a good one out there somewhere with your name on her.. lol.. it will just take time.

Sadly, it sounds as though your wife may benefit from professional help. She may not be willing or able listen to reason. I respect that you have tried to be a good, reasonable, generous guy and you are trying to do the right thing. You've come to realize that your marriage is not going to work. Unfortunately, the only sure-fire way to move this situation forward is going to be with a good divorce lawyer. You certainly have grounds for divorce and it sounds as though she will have little claim on the few assets you might have. Recommendation: Change the locks. Discontinue communication. Do not sign over or give her anything else at this point. Have your lawyer serve her with divorce papers. If you decide to give her the car, etc. you can do that when it comes time to settle the divorce. The longer you delay, the more it''s going to cost and the more you will suffer. Put it on the credit card and be done with it. If you need a good referral in S. Fla, the guy I used wasn't cheap, but he was worth every penny.

When you file for divorce, BOTH parties will be STOPPED from detroying, selling, buying, spending any of your shared assets....usually because of the length of time you have been married, equity would not be shared fifty fifty, as they will take into consideration what you had PRIOR to the marriage.

You do not have to stay in an abusive relationship, you can get out, you are not alone.
