my fiance and i had to file bankruptcy cause of Fords "cutbacks"...anyway we were buying a modular home before the fall of the economy but now have to give our home back..
we live in Michigan and the bankruptcy lawyers dont know their *ss from a hole in the ground...
we are giving up the home, not paying mortgage payment, lot rent cause unemployment just isnt enough...
anyway by law how long do we have? do we have to b served with a notice?
i know we have to move and are packing as i type but in the community where we live we have seen where peoples belongings have been thrown on the streeet...we dont want that to happen...
we asked the bankruptcy lawyer if we will get certain amount of time, if we would b served papers and he said "you should, maybe, be prepared"..
we are two adults (no kids)...how long do we have to move according to michigan law (its a modular)?

It is a legal action so it must go through the proper proceedings..it has to be filed at the courts and a court date must be issued so you have to be served...so just take about 30 days from the courtdate this is just a rough estimate but you can call the courthouse... |

i would contact your local city hall and ask someone in there, if you arent paying the payments on it, i would suggest doing what you are doing, continue packing. start looking for some where else to live. if you want to stay there until you get evicted i would put most of your stuff in a storage place and pay the monthly rent on it. so that you dont lose it if they do throw you on the street. if you can i would just get another place asap so you dont get thrown out. |

You should get a foreclosure notice telling you the amount you owe in back mortgage, how long they give you to pay for it and if you don't pay it then you will get another notice telling you that your home has gone into foreclosure. After that it depends on how fast they move on it but since you know it's coming, packing and getting your stuff out is probably the best idea. |
