I just kick out my husband but he's coming back tomorrow and they say there's nothing they can do to stop him from coming back. He's not on the lease and thank God for that!! But pointless at the sametime since I or rather my mother has to fork out $$$ for his stupid A s S!! So in Houston, Texas how much will it run?? Or is it better that I just file for a divorce?? Or would he still be legally able to live here either way? IDk I need some advice

I just don't get it? Why would it be illegal to kick him out? I just don't want to be with him anymore?? I think the laws should be changed! If the name is not on the lease they have no rights.

you would need to get an eviction notice. that takes time. unless he's violent, then you can get a restraining order that would prevent him from being there. otherwise- it's illegal to just kick some one out whose primary residence is with you. in some states you have to give him up to 30 days notice to leave.

I found this online: If a landlord alleges a tenant is not paying rent, the Landlord is required by law to give the tenant written notice to vacate the premises. This notice can be delivered to the tenant personally with a witness, by certified mail (return receipt requested) or by any other method allowed by law. Unless your lease specifically states otherwise, the law requires you to deliver the written notice, and then wait three days before filing your suit in Justice Court. This is a legal requirement which must be met and cannot be overlooked.

The thing you need to do is go to the police and tell them what happened to make you feel you need to get a restraining order
They will inform you what you need to do to get this part of you life behind you Its best for you and your Kids

change the locks and get a restraining order, then have his *** escorted by the sherrif/police dept. to come and collect his things.
