My sister in law's husband has become abusive and alcoholic. He is not giving any money. My sis-in-law earns Rs1200 only and she has two sons who are studying and this money is just not enough. They live in a small village in UP, India. I want to know how she can claim a share from his income. Also , how can she save her husband's ancestral property before he could sell it for his addiction. Pl reply Asap

wouldn't she have to file for divorce before she could claim some sort of settlement? u should find an attorney who knows the laws of your country. |

ask her to file a case in court. and , since her husband's ancestral property is involved , it also means her children can have the right to claim that property ( i dont know about this clearly , but i think a grandparent's property should go to the grandchildren and not their father ) .
anyway ,ask her to do it quickly . |

well she can surely claim for the maintainable allowance from the court she has the right to take a part of his salary for her and sons maintainance the best idea would be approch the court and tell me the age of sons |

See if you are Hindu community your sis-in-law can file a suit Under Hindu Maintaince Act (Else Section U/s. 125 of Cr. P C ) for grant of maintenance, for herself and her children.
She will get the due share in the ancestral property, she will have file a suit for permanent injunction against your brother to restrain him from dealing in any manner with the property.
