She had a child to a previous marriage, and asked for NOTHING from the Ex. I mean NOTHING . no child support or anything. We started dating, she fell pregnant. I took on her 2yr old, and wasn't the sort of person to leave her with my child, so I went into instant fatherhood. After 18years, We now have House, car and furniture to a total value of about 500K. As things do, the marriage is taking a downward slide. Neither of us can see much of a future, so I sleep in the house, in a different room.
I really need advice as to (1) Whether to leave the house. (2) Is she entitled to the 70% of everything.(3) what rights do I have.(4) Can she legally keep the house and furniture and everything ??
I live in Perth Western Australia.

I think you should listen to nothing that she says. NOTHING. write down what you want.Write down the questions. And follow the advice that comes from a soliciter about divorce and family related issues. these problems can be solved. Find out which way to proceed. Phone legal aid and have a trained proffessional return your call for this information and brochers. .. the whole thing is a pain in the ****. dont get emotional cause you should be happy that your loosing the money hungry *****. Don't loose the money though.( start by putting cash away in your brother or sisters bank...fast). |

DO NOT move out of the house. That's abandoning. Get a really good lawyer. It's money well spent, How much she gets will depend on how good the lawyer is more than the laws.

Consult a lawyer right away because there is a good chance that she has already. Ask them these questions and fast, I don't know how the law works in Australia but I am sure that time is of the essence and it maybe a good idea to not move out of your home or let her move out with your child or children. Again consult a lawyer right away!! |

Like everyone else is going to tell you, you need a lawyer. In the States, depending on what state you live in, most couples will see at 50% split. Depend on how much each individual makes will help determine support for any kids. Depending on the State, spousal support can go either way. Talk to a lawyer. Never agree to anything she hand you to sign, if you end up in court without lawyer never agree to anything because her lawyer says it is the best deal you can get. Talk to your own lawyer.
