What I wanted to find out was, How do I find out is if he divorced me in another state without me knowing? Additional Details Washington State says he can divorce anywhere and say he does not have to know my where abouts and go from there and divorce me anywhere from any state service by publication so my question still remains how do I find this out because Washington State says they dont have to be notified for the marriage records.

Okay I' am going to pretend I didn't read the other answers on this question. First off you don't necessarily have to sign any divorce papers. I'm in the middle of a divorce and for a long time I had no idea where he was at. I had the option for publication or posting... Neither of these requires your consent. I would go to the county you were married in and ask them. He may have divorced you.... That is a very long time to be separated. The county you were married in should have some more resources for you. Good Luck |

The only way he could have divorced you without you knowing it is if he filed on the grounds of abandonment and couldn't locate you through reasonable means to be served with the divorce petition. In order to do this, he would have had to place an ad in the classified section of the newspaper in the last city that he was aware of you living in. The ad would have to run for 30-60 days depending on the state. In the case of abandonment, this serves as notification of intent to divorce and gives the other person an opportunity to contest. So, if you have no idea where he is and he has no idea where you are, your best bet is to check with the local newspaper to see if such an ad has been run in the past 15 years. If you have his SSN, or enough other information about him to identify him, you could pay an online service for a background check. These typically include information that is a matter of public record, such as marriages and divorces. If you use such a service, you might also be able to find out what state/county he filed in (if he actually did) and be able to obtain a copy of the divorce decree if you need it. |

He could of ,all he had to do was say he has no idea where you are and fill out the papers for divorce .Which is $150.bucks in california.Because that is the fastest way to get a divorce it is final 6 months from the day you file.Anyway just go to any court, county clerks office and ask them to do a search for you.They might charge you 15.00 for the search. |

This is going to be tough unless you know where he lived from 1993 to now. Try the counties where he lived and check the courthouses for records, they are public. He could have divorced you without you knowing, its called "service by publication". If none of that is possible, divorce him. |

A person can divorce their spouse without serving them divorce papers or having them sign the divorce papers. All you have to do is tell the court that you have no idea where your spouse lives. You are required to put an ad in the legal section of your newspaper for 2 weeks stating that you have filed for a divorce.
It would be hard to find out on your own if your ex every filed for a divorce. You would probably have to know what state and county he would have filed the divorce in.
It's possible you could go on line and pay to do a background check on him. It would give you his criminal background, places he's lived, date of marriage and divorce.
If you want to be divorced from this guy. You can file for a divorce, even if he has already divorced you without your knowledge.
Also go to the county courthouse in your state. Tell them you haven't lived with him since 1993, he has moved out of state, you don't know where he lives and want to know how you can find out if he ever divorced you, when you don't know where he has been living for the past 15 years. They might be able to give you all the answers you want. |

You don't necessarily have to sign any papers to be divorced. I divorced my husband without him signing anything because I had no idea where he was and I wanted to remarry. I had to put a publication in the newspaper stating that I was filing for the divorce and he had 28 days to respond, no response and I was granted my divorce at my next hearing. You should check with the last county you know of him living in, and if not, there are national registries to find out if you are still married or not. I'm pretty sure divorce documents are public record in most states. I would probably makes some calls to city hall in a state you think he might have been in. You could hire someone to do the research for you. Good luck! |

1 - if you want to ask him, use one of the many "Find ... for $19.95" Internet people finder services to locate him.
2 - if you find that you're still married, you are now eligible for half of his retirement / social security. And if you've earned more than he has, he's eligible for yours. The rule on social security is '10 years married'
3 - if you find he's passed away, you need to look at your rights to his estate
4 - if you find you're still married, you can now decide to get divorced if you want, or explore your rights with a lawyer.

Actually most states have a law that says one spouse can run an ad in a paper for 6 weeks via the court and if the absent spouse doesn't respond within that six weeks, the courts will grant the divorce without the absent spouse knowing or haveing to sign any papers. It seems that you had better find out because you are potentially screwing up your future retirement benefits. You should contact him and see if her filed for a divorce so you can get copies of the papers and get on with your life. You dont need papers to keep from making a third mistake, ur a big girl just dont do it agin. |

First, if your husband wanted to divorce you, it's quite possible you would not know. All he has to do is give the court the last address he had for you, mail a copy of the complaint by certified mail 3 times to that address, publish the notice of the complaint in the newspaper you would be most likely to read at that last known address and when you do not file an answer to the complaint, he can get a divorce from you without you knowing or doing anything.
You would be smart to institute divorce proceedings on your own, regardless of what he may or may not have done that way, just to protect yourself from any financial liability you may have for debts he as accumulated. If you are still legally married, and you live in Washington which is a community property state, you are responsible for his debts and technically he can claim 1/2 of your assets...
It would take forever to check the records of every county in the United States to find out if he has filed for divorce in that county. |

There are some states, like nevada, where you can get a divorce, and the person is never made aware of it. Someone can witness (lie) that they tried to serve you the papers, and you refused, or that you accepted and make it look like you never responded. Then the person basically gets the divorce with all the conditions set out. And, if your husband is in jail, dishonesty probably goes well with him. So, you have to do a lot of checking to find out if you are divorced. But, if he is in jail, ask the prosecuting attorney who made the case against him. They probably collected a lot of legal history on him already. |

I would find out exactly where he was living when he got arrested and then call legal aid society. When you speak to them, explain what happened and they should be able to help you find out. Especially if you want to divorce him. They specialize in that stuff for free. Other than that you can try to look up records in his towns legal section of the newspaper. You'll probably be searching for a while but I do know for a fact that if you are trying to get a divorce and you don't have your ex's information you can still file by placing an ad in the local newspaper in the legal section. If the other person doesn't respond in 30-90 days (depending on the county), the divorce goes through. It will take a while to search but if there's nothing in the legal section your probably not divorced. Usually the guys let stuff like that go and the woman usually files first. Especially if the guy is in and out of jail. Hope this helps. |
