me n my husband have been seprated from last 3 months we lived with his parents we dint owe anything in joint names do i get something from him if he applies for divorce and how long till he can file for divorce ?

if there are no as setts shared jointly its doubtful if u will get anything at all. anyone can file for divorce at any time they choose. u can always try to ask for alimony or child support if u have kids. but usually one doesn't even get alimony unless its been a long term marriage and u never held a job. if he kept his as setts separate they belong to him. |

A lot of the outcome will depend on factors like how long you have been married and if there are any children involved.
If you don't actually have any mutual assets (No house or other property, etc) then all it comes down to is money. If you have separate accounts and he has a lot more money than you, you'll probably get some of that.
As you were living with his parents, though, and make no mention of children, I assume you are not well off, so in all likelihood you would get little to nothing, even if you did decide to go through the courts.
If the split was mutually decided and there are no kids, it's probably best to get a 'quickie' divorce as soon as you can (Which I THINK is six months after separation in most places in the West). As you're both agreeing with no fuss, that should cost little and you can both start new lives.
You should probably consult a lawyer for exact details there, though. |

If you have enough proofs of your marriage then you'll get around 35 % of your Husbands earning as maintainance but you'll not get the if you'll marry someone after the divorce depending upon the thinkings of both sides and arguments it may take minimum 6 months to 5 years but these days cases are resolved speedly so probably you'll get the judgement within a year |
