I would like to take my two sons away on holiday to Edinburgh in August.
I did prewarn my ex husband about this in November last year,as he has the custody to them.
And at the time he said that would be ok
My son's are 19[whom also has a mild case of autisum
and the youngest is 14.
But the other day my ex said he went to see his solicitor and he said i couldn't take them,what i don't understand is why it took him so long to find this out.
The boys have been looking forward to this,as it was my aunt who has paid for this holiday,as a family holiday.
I don't knoew if my ex is just playing games or he just doesn't want them to go.

I think as long as you are not going outside the UK your ex cannot stop you. My ex has tried similar tactics. Have you tried speaking to a Solicitor or Citizens Advice Bureau they should be able to explain the terms of your custody agreement with your ex.

Edinburgh is within the United Kingdom, so he can't stop you and nor can the Court. If you wanted to take them abroad you would need his permission but then if he wanted to take them abroad he would need your permission. Permission is required from all parties who have parental responsibility - mothers automatically have this, as does that father if the mother is married or has been married to them. This obviously only applies to the 14 year old, as the 19 year old is an adult and no longer subject to the residence order.

The only permission you need is from your ex, as he has custody.
His solicitor DID NOT tell him you couldn't take the kids on vacation. More likely, his lawyer advised him not to allow you to and cited cases where the children were never brought home again. Your husband is too weak to discuss this with you, so instead he lied and told you his lawyer said he doesn't have the authority to let you do this.
