Ok a friend of mine is freaking out and doesnt know what to do.
what happened: his mom was married once, got a divorce, got married to man #2.
Man #2 owns the house. One child is his, 2 are the womans.
I just got a call from my friend James (one of the moms) and this is all he said:
Hey guess what im really sad because my dad just left my mom and now i have 2 movie becuz my mom cant affored the house so im realy despresed.
then i asked what specifically happened:
He just called and wanted us 2 get out of his house.
so is that legal?

He has to allow you time to leave since they are married. No police agency or judge is going to just toss them out the door. If he doesn't want to be married any longer he can live somewhere else. Also it depends on the state how the assets and divided and he may owe alimony as well. She needs to see a lawyer tomorrow to find out her options and if she does not have the money she should call Legal Aid and ask for help from them or where to go. She has more rights than she might think. You also have to remember we only know what he said maybe his wife cheated on him. |

I'm confused by your question.
If I'm understanding it correctly, no. He can't kick his wife out of the house. Who's name is on the property doesn't matter much when you are married. She can divorce him and possibly get half of the house.
On the other hand, its possible they can't afford the house after they get divorced. That is common. It is more expensive to maintain two households than one. |
