My ex and i are going to court for custody of my kid. We have been separated for over 4 yrs and i'm ready to get divorced and it seems he his just dragging it out. Can i file for divorce even if there is no custody order as of yet?

Yes, file for the divorce right away and have your lawyer file for temporary custody of your child. If you are a fit mother and the child has been living with you for the past 4 years, you have a good chance of getting full custody when you go to court. |

Yes.. Divorce and custody are two different things.
If he's dragging it out it's probably only to disrupt you and stall you from living the life you want.

A question for your lawyer but yes and it would most likely cut your costs. Just remember never use the child as a wepon or tool aginst him it will devastate the child. |
