If some1 pays child support to a no income person then that person marries some1 with income can it be lowered?

A friend pays 600 a month child support and the girl wouldn't work before she received child support so she could get more. Now she is married and has her hubbies income, can she be taken back to child support court to lower payments? The guy who pays it has two other children to support.

So let me be a little more clear, it's not that my friend don't wanna pay, it's that he has two other children and one on the way to support. She won't let him see the kids but once every other week and when it's a good time for her. She lives with her parents and doesn't pay any bills. It's not that he's complaining about paying for his responsibility, he loves those children and he doesn't expect another man to take over. I was just curious as to what the laws were, I have never been through child support.

no, marriage is not considered in a modification, HOWEVER, now that he lives there, and shares the bills, he should be able to get a downward modification, since she is not paying all utilities, all rent or mortgage, all the car payment, all the insurance, etc....

he needs to file for modification, and send her the form to fill out, and if she still claims she pays all of everything on there, she has likely perjured herself...you will likely have to have her income supeanad, his income supeanad, supeana the utilities, etc...

No, only the parents income is taken into consideration. Her husband is not responsible for another mans child financially.

No. The second husband is not the father of the child, so his income isn't used to calculate child support. And even if she isn't working, the child support is calculated as if the mother was working a full time, minimum wage job. Does no one read their child support paperwork?!

No, the fact remains that she still has no income. She is the biological parent, not her new husband. His income isn't considered in the amount of child support that must be paid. The only incomes that are considered are of the two biological parents.

generally no, they wont lower it when she remarries as the child is still the bio dads responsibility, which i think is really wrong since the mother is now not a burden on her ex (financially at least), someone else is providing a roof over her head, food on the table so it's not like the dad is having to pay so much. payments will only be lowered if the bio dad has more children to support.

In n.c if the mother has a job then he can ask for a reduction not her husband income .

A lawyer would best be contacted. Yes there are provisions that do include: if a woman with children remarries the monthly payments will be reduced depending on the new husbands income.

someone is married and quits working to have a child, then go back to work,only then to not want to work and have another kid then divorces and remarries to a wealthy person (millions) and does not work or want to work do you think child support is still needed or a modification of the amount, determined by the new husband's income, due to the matter of her not needing or wanting to work
