I was never married to my son's mother. I was away when I was in the service but have always had a great relationship with my son. I have been unemployed since Nov 08 but am starting my own business. She has since gotten engaged. I have been threatened time and time again by her about going to court and I am just ready to go so she cannot tell me how my visitation will go. I want to have my son more and we live within 15 miles of each other. My question is do I stand a chance at getting joint psychical custody? PLEASE HELP!!

Full custody no. But if you beat her to the punch and request more visitation rights and present a good case I actually think you would get more visitation. It is rare for a father to preemptively request increased visitation. If you want to see your son more figure out exactly how you are going to provide for him and go get a good lawyer. |

Since you guys live so close and if you see your son often as of right now, you have a great chance of getting joint physical! Take the initiative and print the paperwork from online right now.

well i would love to tell u sure u do, but it really depends on a lot of things that we may not know about, and what state u live in, the laws are not fair when it comes to men and there kids, good luck |

im currently in a custody battle too. from a marriage, though. umm it doesnt look real good for you, but how old is your son? if you ask for half custody, and she's willing to give you half, then you're fine. if she won't give you half, then you might be in trouble. anyway, try to discuss this with her before court to save money. answer these questions and i'll respond again. add some detail. good luck! i'll follow this question |

Sure why not you are the father you have every right to have that kid just as much as she does. Take her to court and get your visitation. I think the only thing they look for is if you have the right means to take care of him when he is in your care. Which I am sure you do. Go for it that would be a great thing for your son. |

We need more info. Have you paid child support and kept it up to date? Do you have any dependency problems? If you are a good guy and a good father I don't see why you would have a problem. It is in his best interest to have both parents in his life. |

i think you can.
she cant keep you from seeing your child unless you cause harm to him. or you have a history of abuse or something.
and if she tries keeping your son from you, you can press charges.
