My ex remarried and he claims he cannot afford to pay the amount agreed to, but his wife works. Can I use her income as well?

no, but it also doesnt necessarily matter if he can "afford" it. if its court ordered he must pay it. regardless of any car payments, mortgage or anything else he may be over his head in.

I'm not sure about NY but in California, the new wife's income isn't considered. It shouldn't be either. Why should she have to pay for his and your child? She had nothing to do with it.
