My cousin is in a terrible situation.
She lost her job & her husband kicked her out of the house because she's no longer "paying rent" to stay there; even though she's been paying the mortgage for years. [Please don't be quick to judge. She didn't fight it because she's afraid of him. She has filed 2 police reports against him for physical abuse-& even then, the reports were brought about from her neighbors who witnessed the abuse & called 911.]
Her husband took their almost-3 yr old son; and left her and their 13 month old twin girls to fend for themselves (soon after she lost her job). She found out she was pregnant, & just recently had a miscarriage (we think the loss was due to stress). She fainted last night & was rushed via ambulance to the hospital.
Long story short, after many attempts to communicate with the husband and schedule a meeting so that she can see her son, he makes empty promises and plenty of no-shows when meetings are scheduled. We tell him she just wants to see her son, and he says "TOO BAD". At this point, she hasn't seen her son in close to a month now. What can be done? They're not divorced, though she's looking for a lawyer. How can she see her son? She has called the non-emergency police number & they told her it was a civil issue; & it's not "kidnapping" because her husband has custody of him as well. ???

Yes it is kidnapping! the child is in harm's way and needs to be taken back for his safety. It sounds like a relationship that she needs to be out . This might be the best thing that has happened to her in the long run! |

It is kidnapping just because he is the child's parent doesn't mean he can take him away and not let her see him.
She needs to speak to a lawyer, she should be able to get legal aid. |
