I am pretty sure that her Ukrainian marriage would be recognized in the US making her marriage to your son illegal without her getting a divorce.
The thing is, who cares if it is ok or not; doesn't it give your son some pause that this girl is already married to someone else and has children? Doesn't it worry you both that she hasn't divorced her husband yet?
Eeep! Your son is 20 and he is about to enter into a ready made family with all sorts of interesting issues. Is your 20 year old ready to be a step-parent?
Back to your question though, your son would only be legally responsible for the children if he adopted them as they already have a father. However, if the mother decides to gain custody (which she probably can't do as there has not been a divorce).
He would be the step-parent and responsible for the children on that level.
I could be wrong, but it would seem that maybe she might try to marry your son while keeping her marriage in the Ukraine, gain US citizenship and then get the marriage annulled on the basis that she was already married. Move her husband to the country and have a happy life. Of course she probably could be deported and possibly lose her citizenship eventually, the key word is eventually there would be so much red tape I highly doubt it would ever happen. |

No it is not legal! If you get married in ANY country then you can't marry someone else in the US. All marriages are legal binding contracts. She can't get married to your son if she is still married to another man, regardless of what country the husband is living in.
However people get away with marrying other people while they are still married because no one does background checks (however it is called illegal and if someone wanted to get her thrown in jail for marrying more than 1 man at a time they could). So if you cant talk your son out of marrying her while she is still married, go to the police and ask how you can get her prosecuted for marrying more than 1 man at a time.
Also , no it does not make him responsible for kids she has from another marriage, everyone knows he is not the father so he would not be held legally responsible for those kids UNLESS the birth father gave up parental rights AND your son legally adopts them, which probably will not happen.
Also if she is an illegal alien, best thing to do (after your son marries her, if it happens) go to INS (US citizenship and immigration services) and tell them she is still married to another man in another country and say she used your son to become a US citizen. You get most likely get them to go after her and press charges and boot her out of the country. In addition for her to become a legal US citizen she and your son have to go through an INTENSE interview process and review by INS to prove they are not getting married just so she can become a citizen (and at that time tell them she is still married).
Try to get through to your son first. Tell him if he really loves her then she needs to file for a divorce first (and pay for it herself) and then get married. If he wont listen then it is not too hard to get rid of her legally by contacting the right people, aka INS and police. |

Anyway, to answer your question, no your son cannot legally marry someone who is already married. And just because someone marries a woman with children (assuming this person was divorced) does not make that person legally responsible for the kids, unless he adopts them. |
