I have a friend, seriously it's not me - i like girls-who is contemplating a divorce. he and his wife have been unhappy for a while. however, over the last 6 months or so, he has befriended another straight gf of mine and they text all the time. ALL THE TIME. he said, in regards to the court visits for the divorce, that he's not worrying about the texting b/c texts are not admissible in a court hearing for divorce, fraud, murder, rape, or whatever. does anyone know if that's true or not? seems odd that they can dump phone line, use that as part of the investigation to tie things together but can't use txts to prove that someone has been having inappropriate conversations with a person that's not his wife.
serious answers only please. i'm really concerned for my friends.

what if the messages have been deleted from the actual phone. can the records be supoened (sp?) from the wireless carrier?

I don't know where he got his information but if she's got a really good attorney I would place a big bet that they would be used. Depositions and discovery often ask for "any" type of communications (and they mean any, fax, cell, text, e-mail, phone, everything!). Good luck and God Bless. |

It depends on where you live...some states can and will use them...but it really doesnt matter if he is already in the divorce proceedings and the paperwork has been filed... |
