You can try. I would first just try asking her parents if it would be okay for you to take your daughter. If that doesn't work, then file for full custody on the grounds that she is in jail and cannot care for the child.

If she's in jail yes you can go get the child...Unless you have not been actively in the child's life. Then you should consider the adverse affects it will have on the child being away from those familiar to her.

You should be able to. I would show some respect toward the parents and get them to see that you are a good dad. Spend some time together with them and your child, then do short visits and once they see that you are good with the kid it will be easier for them to let go... If they are crazy I would just go in for custody rights because that is your child and if there is nothing in your records to show concern against you as a parent, you have the right to the child over the grandparents..

You have parental rights. . .if you can prove you are the father. Have you contributed support up to this time and established that you are the father? Get an attorney or try children's services for advice.

You need to call your attorney, if you don't have one find out who the public defender for your city is and contact them. They will plead your case to a judge to get immediate custody of the child, if you have a stable home life, and a job and no restraining orders against seeing the child. Seek counsel and they'll work with you to get your child, you are now the custodial parent since her mother is locked up.

Are you talking about getting custody? Or just get the kid till she gets out of jail? What is she in jail for? If you are talking custody,I would definitely go to court. Tell them the custodial parent is in jail & you want to petition the court for custody.Talk with the court clerk.They are a wealth of information & can help you out with the details. Good luck!

I think you should talk to her parents and see if they will let you take your little girl and if not you need to get an attorney and see about your parental rights. FATHERS HAVE PREN TEL RIGHTS AS WELL AS MOMS.

Not if you are not listed as on the custody papers. You will have to get a lawyer and go to court and petition for custody. Also, can you support a child?

Does your daughter know you well, does she have a bond with you and will she be comforted by being with you? If yes and you are in a position to take care of her and support her adequately then you probably can. If she doesn't know you, then I would say you need to become part of her life, taking a baby from people she knows and lives with could be potentially traumatic for her and distressing for you. Take it slowly and talk to her grandparents about visitation and allowing you to build a bond with her.

You can only because you are also your daughters legal guardian.I would suggest taking an officer with you to avoid any issues.

YES YES YES !!!!! Go get her! If she is not with mom she is with you & make that very clear to everyone! (Pushy Grandparents, nosy aunts & uncles... know it all's) Then file with the courts for full custody, immediately! If mom has issue's & sounds like she kinda does you need to keep your daughter with you!!
