My ex husband pays child support, how much do i get?

I have been married to a divorced man with two children who he pays child support. We are now separated, I don't have a job so I don't have money for a lawyer, but would like to know if anyone knows about how is the child support divided into the two families? He says that I should get 1/3 of what he already pays, is this correct?

Well some of you are really nasty answering my question! I thought this was a helpful place, not to get attacked. If I don't have a job, it has been because of the economy and I do have a degree! I have one child with him, but he's trying to interpret the law to his convenience. I am looking for a job, but it has been slow! So, if anyone can HELP with info I greatly appreciate it. But if you're just going to attack without knowing, don't bother to give your opinions...

Do yo have a kid with him? If so than yes you are entitled to child support. If no kids than you may be entitled to spousal support. You will definitely need a lawyer!

I assume you wouldn't be looking for child support if you had no children. There are online calculators that show how much he will pay in your state. I'm not sure how it will be divided among the kids, though. Try calling the office where he pays cs now, and asking them. That's where you'll file, too.

Also, try Legal Aid (in the phone book) for low-income legal services.

You have no children together - you get nothing. That said - there is one thing you should get - A JOB!

The money is based on his income, if he is forced to pay your children (not you) then his current child support, the number of children, and his income will all be factors.

If you have no children together, you get nothing, and not having a job is irresponsible as a parent. If you want custody you need to support them as well.

I think it depends on the state for spousal support . Also you have to pay taxes on alimony. If u have kids with him you will get child support but it will be less as the older children come first in the order (at least in my state).Any child born after that is worth less...

That means that for the next two decades he has three to support, each costing him approx $250,000 to age 18, or about $1000 per kid per month, less early on and more later.

That buys those kids nothing but a belly of cheap food, tv, plastic toys, a computer, some dope in hs. It does not include braces summer camp, horses, dogs, RVing, fishing, walks in the woods, museum trips, binoculars, trips to Italy, nothing.

Do you get any of it?

Nope.
Get a job.
Get back in school so the job is a better one.

Unless you have a child with him, you get zero.
Usually the most they can legally take from a man is 50% of his income for his child support, so if you have children, divide the number between them and his other two and figure it out.
