This past March I left my husband because he is verbally abusive. He has hit me in the past and has threatened to kill me. He tells everyone that I am crazy that I left him and that I dont know what I lost out on. You can not force someone to stay in a relationship. He has my daughter and uses her as a pawn to get his way. He has mantrums whenever things dont go his way. I am so tired of him and live in constant fear for my life. Ya I went to the police and there is not much they can do. I just want him to leave me alone. He says that I will never get my daughter back but the legal system at the moment is not concerned about her well being. My ex is bi polar and he admits it. What can I do to get my daughter back? And if you were in my place what would you do?

I have talked to lawyers but because I left the county where I lived I can get no legal advice.
I never meant to leave my daughter. I tried to make everything seem as normal a day as possible until he got off of work early and realized that I wasnt at home. I had dropped off my daughter about an 1hr before and left the house with some of my belongings when he got home a few minutes after I left. He got to the day care before I did. The cops wouldnt even let me leave with her when I tried to go get her.

If the state believed he was a threat to the child, they would have removed the child from his care.
Depending upon how long the child has been with him, the evidence you have to present a court, and the nature of your relationship with the child AND the husband, you have a SLIGHT chance of getting the child back.
In all honesty, unless you can prove he is a danger to the child, you're fighting a losing battle. |

First of all, I would have taken my child with me. If he's abusive to you, what's to stop him from being abusive to her?
Stop listening to what he says. Get yourself a lawyer and petition for custody. You need legal advice, not Y/A advice. |

Let your case manager know, Let Child Protective Services know, I would also file a police report on how verbally abusive he is just to have it on file. When ever you have conversation with him, try to record it with your phone, pretend like you are putting your phone on mute. Tape record it, you can get them from Walmart. I would do all I can just for the child's sake. |

Go see a lawyer or a solicitor about this, if he is mentally unstable as well as a violent bully it seems unlikely he will get custody of your child as she could be at risk of significant harm, have you considered bringing charges against him for assault? |
