I live in Australia. I was with my ex for 3 years and i have a personal loan in my name for him (i understand now how stupid i was to do this). It was $6000 in total. Plus i spent heaps of money on him. He dumped me lasxt night through a text and now i want to know what i can do to get the money back. He admitted in a text him spent the money on it and that but do i have any legal right?

It has to be established as a loan in court.He has to admit to owing you to the judge.If he says it was a gift you're screwed.I'll bet you'll never loan out that kind of money again.I see it on the court shows all the time.They have to admit it's a loan from what I see,like on Judge Judy,or any of the other ones.He's a real dirt bag for doing that to you.So sorry. |

You need to see a solicitor as the variables here are too many. Your solicitor will advise you correctly on what to do rather than look for answers here. It may be a civil action case but you definitely need solid advice.
Nearly all solicitors give you the first meeting free of charge, just ask when you phone them. |

Well legally you borrowed the money and took the loan out and it his name isn't on it at all then he is responsible for the pay back of it. Unless you were married and then he is still responsible for half of the amount. It doesn't matter if you gave him the money after you loaned the money. When you put the money in your name you said that you were the one to be paying it back. At least that is the way it works here. |

If he has "conservative" parents - they could be easily shamed into paying you back.
I would plead poor with them. (show them statements and all)
But be nice and fraught with sadness - not demanding or patronising.
They are your best chance.
Be careful that he is not a violent sort - as it may not be worth the money
(6000...low interest rates at the moment - might take you a year to work off at 130p/w).
It's not ideal to just cop it on the chin....but could be the best option compared with an ongoing saga. |
