Question about child support?

My fiancee got a job in which she makes $18 an hour. My ex found out about the job and wants to take me back to court to get more child support through my fiancee. She can't base my fiancee's income for child support, right? It should be only MY income, since it's MY child. She thinks my fiancee should have to pay along with me, since my fiancee makes good money. She can't make my fiancee pay, can she? This is unfair and she's a goldigging *****

By the way, I didn't tell her about my fiancee's job. I don't talk to her unless it's about my son. I don't know how she found out about the job, she's crazy.

It will only be based on your income and your ex's income. I know because my husband and his ex-wife just went through this.

Nope, she can`t. You are right, it`s your responsibility, your child, and only your income. If you fall behind, when your fiancée becomes your wife, there might be problems with income tax returns, but other than that, she can't go after your fiancée`s money.

She can't get ANY of your fiance's income and when she becomes your wife she won't be able to touch that either! Hopefully, she won't get far in her attempts and the judge will see right through her guise.

Dude, you will have issues until your son is 18 as your ex is nuts. Just have her contact her lawyer to ask him if she can go after your fiancee as the answer is a big NO! She obviously sees you as her gravy train. My ex is similar. Mine also thinks of the child support as her money and if she uses for my kids, she stresses to them how she is paying for their things, of course not letting them know it's with my money. One tip I'll give you is to file separate tax returns once you get married so she never knows how much your fiancee makes. I've been doing it for years and even though it costs me a little bit, it keeps my ex from ever really knowing my wife's income. Saves battles later on.

If the court determines that YOU can pay more depending on your living situation they might change it. That doesn't mean they will. Also, depending where you live she will have to prove that she needs more child support not just to be vindictive and make your life a living hell, but that she can't live without having more money. You may need to get an attorney and definitely review your rights as a parent because there are just people out there who will take advantage of the system because they can. But to answer your question they will never make your fiancee pay anything for a child support case that doesn't involve her.

No, she can not get an increase in support based on any ones income but yours.

You are not married to your fiancee so no worries. Most states only go after the parent of the child. You can go to your state website and find out what are the rules.

No, it is just based on your pay. Why did you tell your ex how much your fiance makes anyway? Even if you marry your fiance, I'm not sure if they can consider her income. Even if she found a dirty lawyer, she isn't making much money so I don't see a judge that would justify taking any of it.

Geez, of course you can't get money out of someone who is not the biological parent.....you know how CRAZY filled the courts would be with greedy mothers trying to be a thorn in another woman's side?

A woman is ONLY responsible for children she birthed herself, for legally adopted. End of story.

No the courts cannot force your fiancee to pay child support for your child. However if you do marry, you may both want to consider keeping your incomes separated. Such as having separate bank accounts and do not file your income taxes jointly.

She cannot go after your fiancee's income. However, once you get married there are states that will consider your wife's income. Check you state laws...
