When my sons father and I split up, he started paying child support...or well was supposed to. In our papers, they also attached visitation papers incase we cannot get along and want to go by them. My sons father rarely goes by the papers and decided he wants something written because he has warrants out for him and thinks I will call the cops if he doesn't bring Caleb home by a certain time...so he decided to write a note saying he will have Caleb every other weekend from 6pm Friday thru 6pm Sunday. Will this paper hold up without it being notarized? Or is this something that we would have to go to the Attorney Generals and actually modify our papers. I don't really know anything about the law...we live in Texas. Any help would be great, thanks!

I don't know about the state you are in but in VA a piece of paper doesn't hold up at all. There has to be a court order or a notarized paper or you can go to mediation to agree. If I were you I would be careful about letting my son go with him if the police are looking for him cause what if he gets caught while your son is with him. That could seriously cause a permanent scar on your son. |

It's better to settle any custody/visitation issues in court, so that it is totally legal and enforceable by law for the sake of the child |

It has to be legally binding in court agreed by you and signed by a judge to be legal. If he is not going by the papers that have already been set, he is in violation now. He doesnt want to go before the judge to do it legally because he has warrants. He is thinking of himself. |

No, it doesn't hold up in court.
For a document to hold up, it would have to be signed by a judge, especially when it comes to custody of a child. |

It wont hold up in court even if it was notarized, that would not be a legal document. Notary does not make it legit. the only legal thing is the custody order signed by the judge. But if you two BOTH agree to deviate from the court order, it wont be a problem. It sounds like you get along with the ex, why would you want to call the cops on your kids father??? You guys can do pretty much what you want if you are both in agreement. You may want to notify one another by email what the pick up and drop off times/dates are and then you have proof that you both agreed to it and the court wont have a problem if you two change things to better fit your life. |
