My ex-husband's new wife has been endorsing and cashing the child support checks that I send him. The checks are written out to him, but she has been signing them in her maiden name. She goes to the same teller every time and the total amount for the checks is $1200. The only thing on the back of the check is her name. However, on the checks that my ex has endorsed there's a string of numbers (his account number?) under his signature. Is there anything I can legally do about this? Would it be possible for him to come back and say he never recieved the checks if I do nothing?
Asking him any type of personal question gets me nothing but attitude and defensiveness and usually starts a fight.
Additional Details
It would appear to me that the kids are doing without when the only clothes they come to me in is clothes I bought them. But that's a seperate issue.
And no, I never endorsed a check written to him when we were married. He would sign the back and I would deposit it when he couldn't get to the bank. If this were the case I would be none the wiser, but I don't know why he's NOT signing his checks and why the bank is allowing her to cash the checks.

If you are paying him child support, you have a right to ask questions. Ask him if he has been receiving the money and get it in writing. You are not writing the checks to her and I'm not sure how she is even allowed to cash them unless they have a joint bank account w/her maiden name? If he is not getting the checks, call the bank and have her prosecuted. |

If his wife is cashing the checks assuming with his knowledge, and the kid(s) are not doing without,why worry? No, I do not believe he can say he never received the checks in the future when his wife's name is on the checks.
