My nephew and his wife moved in with me and my family. They split up shortly after. My nephew has made arraignments to pick up his stuff but his wife has not. How long do I legally have to keep her stuff? She also owes me $150.00 for new tires on her car that I put on the day before her "planned" exit. Is she liable for the tires since she has the car or both? I never talked to my nephew regarding the tires, only his wife! We live in Oregon! Also can I sell her things to pay the $150.00?

You could take her to court and have it all resolved by a judge or call her ask her to pick up her things. Give her a deadline. Tell her that she either pays for the tyres or you'll start court proceedings. |

After 30 days its legally yours....because they didnt pay rent for storage.
After they leave the premises...in a week or so...if u throw it out or sell it...
they cant prove you did so...
But this is family, be leanent |

I believe it's 30 days, as that's the usual time a person is given to get their belongings from someone's place after a break up. But, to be sure, I would ask the advice of someone who would know your "legal" rites. I would say you are entitled to get your money back for the amt. you did lend her, fair is fair in that respect. IF she hasn't contacted you regarding her belongings by now but your nephew did, I would say she no doubt is going to even worry about them. Just to be on the safe side tho, contact an atty. & get their advice about it. Best to you...:) |
