My first wife and I separated before the birth of our second child in 1983. At the time of the child's birth in Oregon rather then notify me of her birth and put me on the birth certificate as her father, she put the name of the man she was living with and gave her his name and as she grew up her mother would tell her I was not her father. She also moved across the country in order to deny me access to my children. It seems to me that because she put this other man on the birth certificate that he was assuming the role of her father and therefore would have been responsible for her support. What I would like to know are 2 things.
1. Even though my daughter is now 26 years of age can I request a DNA test to establish paternity via the courts?
2. If the DNA test should prove I am actually not her father can I seek relief from her mother for the child support paid?

1. Yes, you can request a DNA test.
2. If you were paying child support for this child as well as any other children you know you fathered, you would have to settle this in court.
If you were not paying child support for this child, but for your other children with her, then you would not get any of it back.
Now, what is your relationship with this child and your other children? Is a few thousand dollars worth destroying that relationship? What brings you to this point? Why are you doing this after all these years? |

If it comes up negative then yes you won't have to pay but if it does come up positive and you have not paid then they will make you pay back child support which you may have to pay up to 18 years after her being 26 this happened to my cousin... |
