So should my husband have is kids when there mother is @ work and the father is available to have them even though there is a parent plan....Why should they be with the boyfriend soon to be stepdad when dad is available and we only live like 2 miles away......My husband has always been in his kids life but we have not always lived close but we decided to move closer so he can be more involved and she is having issues about it......

absolutely, he is the father, not some other guy the mother shacked up with - not that there is anything wrong with him, but if the father's available, why not spend the time with him? His kids must be young. Hope it works out for you! Good luck! |

That is how it works for us - when one parent can't watch the child for more than 2 hours, the other parent gets "first right of refusal"... I'd bring it up to her and if she doesn't want to go for it go back to court... |

Does it make sense sure, but the custody papers specifying parenting time has to be adhered to, that's the bottom line. Maybe if the mother is reasonable she will agree to it. |

Because the boyfriend is going to be a large part of the children's lives and it is what the custody agreement says. If HE (your husband not you) wants it changed he needs to go to court. |

Ideally, that's the way it would work.. but if the parenting plan currently does not state it, she doesn't have to go by that.. he should try talking to her to modify the parenting plan.. and if not, go back to court. |

Is it her time with the kids or his? If it's hers, then your husband has to accept that she has the right to determine where the kids are during her time.
