Well, my husband’s ex wife lives in their old home. In the divorce decree the judge gave the house to the ex now the ex can’t make the mortgage payments anymore, since she works part time on $6hr wage. The ex wants us to make the payments since my husband’s credit is online. However, my husband made the payment for 3mo and she supposed to be paying us back but never did. Can my husband just let the house go for foreclosure and just sue her late to clear his credit since legally the house isn’t his? We honstly can't offer to pay her child support and pay her bills.

Well, tell her no more blank checks. If she can feed the kid with the child support let her send the kid to you. |

Whatever money you've given her in the past you can kiss goodbye.
Encourage her to sell the house (either back to him or to a new buyer) and then she can use the money to purchase a more affordable residence. She cannot afford the the house she's in now and, if there is a foreclosure on it, you husband's credit will take a direct hit because his name was originally on the paperwork. When his credit gets damaged, so does yours.
Continue to pay only child support. If she uses it to cover the current mortgage and deprive the child/children, then that's her choice.
You may considered consulting your attorney just to be clear about ways your husband might can protect his credit, however, courts have a history of having no sympathy for even the good dads. |
