What can I do if my husband refuses divorce?

My husband has been physical with me several times during arguments, and I am not going to take it. I want to get the divorce papers today. What can I do if he refuses?

That's not something you should worry about at this point. Worrying will just make you put off the inevitable. do not discuss it with him, he will only get angry and hurt you or he'll put on some kind of pity trip and make you feel guilty. He wont forget it either...i have been married to someone who used to be physically abusive, mentally abusive, emotionally, financially...you name it.. it wont get any better. go get the papers drawn up and move out before he gets them. you may want to think about a restraining order if you feel he will be physical to you! I pray you don't have any kids with him, and if you do DO NOT listen to him! Just take your kids and leave! Your kids deserve to live in a safe environment and so do you! Get out now girl! You don't deserve it! there are many men out there who are worthy of you and who will respect you and treat you the way you deserve to be treated. settle for no less! Good luck

See a lawyer and file for divorce. You do not need anyone's permission.

No one can refuse a divorce. You file the papers, and you get a divorce after a year of seperation.

divorce should still go through, regardless if he wants to sign it or not. But double check with the courts or a attorney i think it all depends what state you are in.

have a legal assistant serve him the divorce papers. if he doesn't sign them within 30 days the divorce is automatically finalized with or without his consent.

I'm sorry I can't actually answer your question, but I just want to say a big, huge WELL DONE! So many women stay in abusive marriages, so well done for having the guts to do it. Go see a solicitor/lawyer and they will advise you on how to go about this. Or look up legalities on the net. Good luck with this and your future. Good on you girl!

If he has been physical and you have not called the police and charged him with assault or at least had him removed from the house for domestic violence, it may be a bit hard to get him to agree to signing a divorce paper. However, in some states, repeated domestic violence is enough cause to have the divorce go through without his consent anyway. If you have witnesses to the fact of the abuse, that would be helpful also. Check your local family court for what's OK in your state.

file now and it begins a wait period-depending on your state even if he refuses to sign, it will be granted by a judge after the wait period is served.

most states it is about 1-3 years average.

first document every time he has gotten physical then go down to the courthouse and file the papers but you make sure you put the right reason down on those papers if you put abusive then he will be more likely to grant you one on irreconsilable differences. But whatever you do choose to do make sure you leave this situation as soon as possible. Good luck

A divorce cannot be "refused". If he has been physical with you, dial 911 and wait for the deputy. Chances are, he will be removed from the premises, and that kicks off your divorce process as well as triggers the deputy's giving you the advice to get a restraining order. See an attorney.

He can refuse all he wants. There is a time limit and if there is proof of abuse the judge usually tends to weigh on the side of the petitioner, providing it's the abused petitioning.

First you need to find a safe place to stay and move out. Second you get an attorney so that paperwork can be filed petitioning a divorce and establish custody if you have children. I know in the state of South Carolina you can get a divorce in 90 days if you can prove abuse or adultery. Check with the laws in your state, they may make you wait a year. If you move out, when you go to court you can ask for permission to get your property out of the home or even ask for the home. If you have children, make sure you take them with you. It looks worse on you if you leave your children with an abusive person. Hope this helps.
