I was married from 2002 until 2008 when i filed for divorce. I was the sole breadwinner as I supported my wife and our daughter. In 2006 I made almost 73,000.00 but that barely covered our expenses and I was unable to pay the taxes owed for tax year 2006 is she liable as well?

Im relieved that she wont go down with me,I was concerned they would nail her too! Yes we spent my "gross" income as I'm self employed and did not file,we were trying to pay all our bills in full for calender yr.2006 so we would owe no one as in December 2006 I began the 1st of 4 surgeries on my skull and left leg arising from complications of injuries sustained in the ARMY during "Operation Desert Shield" and "Operation Desert Storm". Unfortunately it was like robbing peter to pay paul.
I filed for divorce not over the money issue so I can't protect her credit rating with the "innocent spouse " theory .here were and still are hurt feelings about the divorce and the 2yrs of surgeries and rehab so I didn't file returns for 07 or 08 as my only income was my miniscule VA disability pension which is tax exempt.THANK GOD that I have lifetime Medical care from the VA or we would have went under!!Anyway,she is refusing to give me her and my daughter's S.S.#' so I can minimize the taxes owed!

well first you will have to file to prove you owe then you can take her to court and if you owe back child suport they may deduct it if not then they may make her pay half or a thrid call a awyer she should have to pay some unless the divorce is over and your past bills are setteled, but it is just a phone call to ask a lawyer .you should also ask this question in the law and goverment section where lawyers may bei am just a housewifes here, good luck,,,, |

If you filed a joint return, and she signed it, she is liable also. I suggest that you get with it, and start paying on the tax liability as the interest will eat you alive.
Just because you lived over your means does not mean that you can avoid paying the tax owed.

no you earned the money it falls back on you if you claim head of household that's what my uncle did when him and my aunt split he got stuck with the taxes he owned his own company. |

She took care of your daughter, for six years, while you worked outside of the home. Are you going to pay her for that? Come on now! For six years, she stayed home and you didn't file for divorce after 1 yr. 2 yrs, 3 yrs., you waited 6 yrs before you decided that this was the determining factor that lead to your divorce and now, she should help you pay for taxes? You made the money, you owe the taxes. Also, between the two of you, you both overspent. This is why its important for both parties to pay attention to how money is spent. If you dropped the ball on your end, didn't pay attention, well, you learned an expensive lesson, and now you owe back taxes. Time to get responsible with your spending. |

hi if everything is in your name she is not liable, your statement said that your the one who made 73,000.00 it means that your the one working so shes not liable. |

Yup... she is probably liable if the IRS decides she is.
Consider getting one of those tax attorneys to help you settle out with the IRS for a lesser amount, then a payment program. They may garnish your wages for a while and it will be a b*tch.
