You can file the divorce yourself, you don't need a lawyer. If its uncontested, lawyers still charge a lot. For an uncontested divorce, you can find the forms online, for roughly $200. Then you have to fill them out, file them in court, have them served to your partner (anyone can serve, you can even get a friend to serve them - they just have to sign to say they did serve them). If your partner doesn't contest in said number of days, you win. It costs about $200 to file the papers with the court.

You can also get papers online for a separation agreement, and if your divorce is amicable, the two of you can sign a separation agreement witnessed by lawyer/notary, this helps to get an uncontested divorce without the need for an oral hearing.
FYI: No-one really wins in a divorce. If one partner is in pain, because of an abusive partner, then by getting a divorce, this partner in some way wins. If kids are involved, depending on the marriage, they can win/lose. If the home is an unhappy one, sometimes the kids, as long as custody is given to the right parent, can win. |

There are a few benefits of divorce.
- If a person is really that unhappy then ending the marriage does afford them the opportunity to be happy or to re-chart their life.
- If you are the one being left at least you will now be open and available to meet and be with a person that does want to be with you.
- If you divorce because of abuse or violence at least you set an example for your children that shows them that no one should tolerate or accept abuse as a part of their lives.
- If you know you want out and there are not yet children involved at least you are ending things before you are forever tied to someone else through the responsibility of parenting. |

It cost me 3500.oo. The judge decides who gets what if your divorce is contested by either you or your soon to be X. Everything is up to you 2 until you can't come to an agreement then you have to get lawyers and it gets expensive, kinda like mine did. Honestly, you didn't say why your getting a divorce or if you have kids or a house or any real details. If you have kids unfortunately there the ones that pay in the end. |

The scum of society ie: lawyers and judges are the only ones that benefit from a divorce. How scumbags like that sleep at night; I do not know.It costs more than just money,it ruins families,children's lives, and plain emotionally traumatizes both sides. |

Usually nobody (except lawyers, if it's that sort of divorce).
Filing fee normally only a few hundred but if the property agreements and others can't be worked out, lawyers are brought into the mix and the cost can go into the tens of thousands.
If it's an abusive situation then I would say the victim would usually benefit from divorce. If it's a mutual, amicable break-up then I wouldn't say it's a losing situation (unless there are kids).
Makes no difference who files really. Sometimes people file because they are sick of it all and want to leave. Sometimes people file because they have been repeatedly cheated on or something but the other person wants to be separated but not actually divorce. So the one filing isn't always the one who initiates the divorce. |

Divorce attorneys. And generally, whoever has the better attorney comes out ahead. If you want to do it amicably, you can file the papers together and save a fortune. It will also make your future dealings easier if you don't have an adversarial process. There are a couple websites out there that can help with the paperwork. LegalZoom, or something like that, and We The People, I think. Don't quote me on those, though as I'm not certain. Court costs are not very high, if you've agreed on things and don't need to argue in front of a judge, but if you have to hire lawyers, it gets pricey pretty fast. $150 an hour or more in many cases. If there are kids involved, try to agree on things if you can. They need to know that their parents are ok. Good luck. |

well, i wouldn't say it's about filing or getting served. if you think it's right for you, your marriage is absolutely not working and you want out, then file for one. i don't think you get more sympathy or anything for being the one served....no idea how much lawyer fees are, or if you live in a state where everything is split 50/50 or what..... |

i dont think it matters who files or who serves. I think once your in front of the judge, it depends on how good your lawyer is, if there are kids, what prooperties both of you have, if both of you can be financially independent, etc, etc. |

lawyers benefit the most but the one who files has the better chance of getting what they ask for,if kids are involved and you have custody would be better if you filed,if no kids involved the same ,but there is do it self divorce kits you can get at a book store with simple instructions.i have used it myself three times,and also for my friends everything said and done total cost maybe $250.00 filing fee process service fee and book probally over estimated but depends where you live,but book and filing fee is most of the cost and only takes 90 days start to finish,real easy,i guess the one that doesn't want to be in the relationship benefits they get there freedom,other than that divorce isn't easy but we do survive after words hope this helps,friends would suggest u file first and if possible use the do it yourself method cheaper,unless you think theres going to be a fight over kids ect then your cost with lawyer about $800.00 plus. |

usually its the one who files first, the other one is the respondent. its best to already have it all worked out with your spouse before u file then u won't be fighting in court.doesn't cost too much if u both agree, now if u have as setts or children it will cost more. if someone isn't in agreement it cost more. i would think the one who has the most money would be the one who had to pay more in child support and sometimes alimony so that person wouldn't make out as well. 5 yrs ago in the state of fla all in all i spent about 500.00 and this was without an attorney, with an attorney an uncontested divorce cost about 1,500 5 yrs ago, but worth it if u have as setts or want alimony and child support. |
