I am a father just going into a divorce. I have been separated from my wife for 4 years and I am trying to get custody of my child. I feel that it would be a better environment for him to live with me. His mother hasn't had a job in two years, she has lived in 11 different homes over that time, none of which were hers. She lives off of child support from me and the father of her other child (who she had while we have been separated), and assistance from the state of florida. I had him living with me for a year, when we first split up, but one of the times that he was visiting her she never gave him back. I was told by my attorney that doing the same to her during one of my visits with him would be detrimental in court. I just want to know if i have a chance at getting custody.

As far as my bad qualities, i didn't act on this situation fast enough. But divorce is expensive and I wanted to make sure I had an attorney at my side. I have always had a job, paid child support (even though it was not court ordered), spent as much time as I possibly could with my child. I have also lived in the same house since the just after we separated which has plenty of room for him. I am looking for answers from people who have been in this situation before.

Judges hate to separate a child from their mothers. Chances are that you'll get Joint custody. |

How is it that your statement only shows her negative points and not yours!
No one here can tell you who will get custody. That is for a judge to hear ALL evidence in the case.
Maybe you shoouldn't of waited so long to get a divorce and get custody. Of course she had alot of things happen in her life..as well as I am sure you have... you both allowed 4 YEARS to pass before you did something about the custody of your child. |

If she is truly an unfit mother than it is likely that you will get custody. I know a man who got full custody of his 3 kids after a divorce for similar reasons. Make a good case and you will surely get at least partial custody. |

You do if you would provide a better enviroment and all, i would start up some evidence maybe of her lack off support for him. Maybe prove her unfit as a mother or just deal with her having weekends or holidays. If you can fully support the child, proof of a stable home and income, how you will look after child and why SHE can't than i say you have a pretty good case in winning custody |
