Would my ex moving and leaving our children behind with her great grandmother be abandonment?

My ex has custody of 2 of our children. She has moved out of her grandmothers and but did not take our kids. The kids tell me she never calls them and they can't get in touch with her. Their mom has come to visit once or twice in the last 3 weeks. Would this be considered abandonment? She does not give her grandmother any money to take care of the kids in which I pay her a lot in child support. I would love to have my kids but it is so hard for a father to get custody in TN. What exactly does child abandonment consist of ? Would this fall under abandonment?

Oh yes, this is abandonment. Start recording all of this right now! Talk to a lawyer and get an injunction for temporary custody based on the children being left for long periods of time with "an elderly relative", cite safety of the children. Once you get temporary custody, it is a lot easier to get permanent custody.

Keep a log of visits,phone calls, children's statements from this day onward. Okay, good luck to you and those poor mites. Lawyer, NOW.

So what are you trying to do.
It sounds like you are just trying to avoid child support.

Now if it was truly for the kids I think a trip to a very good attorney is in order.

File for a new custody agreement with all of the evidence in hand.

If you are serious and do the PROPER legwork and documentation this should not be this difficult.

Just have her tell the courts that she doesn't want to tend to them, so you should get custody then.

Stop whining about how hard it is to get custody and do whatever it takes. Both their parents have abandoned them, they aren't raising them. Get your Behind in gear and get those kids back. That woman who is there for them is "Grandma" not Mom or Dad. Let her be "Grandma" and enjoy her role as such.

IN this case, how do you think it would be hard? If it's hard, it's because your not telling us something and your not a fit parent, otherwise, those kids would be in your custody as soon as you file the papers and go to family court.

Abandonment means......abandoning the children.

You don't have to leave them at a bus station....just not taking them with you wherever you go is abandoning them.

Be a father.....and forget about what it's called and get a lawyer.

I don't know how TN custody laws work but it sounds like abandonment to me. There are lawyers you can go to for free advice and consultation, you should look them up to see if they can help you navigate this.

You should consult a lawyer in your state, I think that is enough to file charges of child abandonment in a lot of states.

Get a lawyer, and document everything. If you have a good relationship with Grandma, maybe she'll even back you up. If you can demonstrate that you want the kids and can take care of them better than their mother does, a lawyer should be able to change your custody arrangements in your favor. The courts are supposed to determine what would be in the best interest of the children, so make it obvious that you are their best option. Good luck.
